Companies offering covered products or services to consumers in Germany, including e-commerce, banking, telecom and passenger transport. Micro-enterprises providing services (fewer than 10 employees and up to €2 million turnover or balance sheet) are exempt, and B2B-only services are out of scope.

Up to €100,000 for offering a service that does not meet the requirements (§ 37 BFSG), and up to €10,000 for information and labelling breaches. The market surveillance authority can also order you to stop offering the service until it complies.

That is an open legal question: no court has yet decided whether BFSG rules are market conduct rules under § 3a UWG. Warning letters have been reported since 2025. Consumers and recognised associations can already ask the authority to act (§ 32 BFSG).

Services using products already in use before 28 June 2025 may continue until 27 June 2030, and existing contracts may run until they end, no later than that date. New services must comply now.
