Laws & Standards — Australia
Disability Discrimination Act 1992
Makes it unlawful to discriminate on the basis of disability when providing goods, services and facilities. Complaints go to the Australian Human Rights Commission for conciliation; if that fails, the person can apply to the Federal Court or the Federal Circuit and Family Court within 60 days.
Frequently Asked Questions
Does the DDA apply to websites?
Yes. In the first web case, Maguire v SOCOG, the Sydney 2000 Olympics website was found in breach of the Act. Online services are services, so an inaccessible website or app can ground a complaint.
Which standard should Australian websites meet?
The DDA does not name one. The Commission's Guidelines on equal access to digital goods and services (April 2025) recommend WCAG 2.2 Level AA as the minimum. They are not legally binding, but they show what the Commission expects.
What happens after a complaint?
The Commission tries to resolve it through conciliation; outcomes can include an apology, changes to the website or compensation. If conciliation ends without agreement, the person has 60 days to go to court, where damages and orders are possible.
Is the law changing?
The government is reviewing the DDA. Consultation closed in October 2025, and the Commission has recommended a positive duty to prevent discrimination. The outcome is not yet known.
Does the European Accessibility Act matter for Australian companies?
Yes, if you provide covered services such as e-commerce to consumers in the EU. Since 28 June 2025 those services must be accessible, and the scope is not limited by where the company is based.
