6. Intellectual Property

6.1. The Service and all of its components — source and object code, built files, styles, interface design, icons, interface texts in all languages, documentation, the InclusiveWeb name and logo — are the intellectual property of Individual Entrepreneur (FOP) Vdovyn A.V., protected by the Law of Ukraine “On Copyright and Related Rights” and other intellectual property legislation. The Widget is not open-source software.

6.2. You receive a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence for a single method of use: connecting the Widget to your Websites through the line of code provided by us from the cdn.inclusiveweb.net domain and displaying the Widget to their visitors for the term of the paid plan.

6.3. The licence does not grant the right to reproduce the Widget code and files, host them on your own server or in any other content delivery system, reproduce or imitate the appearance, structure, set and names of features, profiles, icons and texts of the Widget, create a derivative, similar or competing product based on it, or transfer or sublicense access to the Widget to third parties. These restrictions apply regardless of whether the relevant element is protected by copyright.

6.4. A demonstration of the Widget, a trial period, a test account, screenshots or screen recordings, documentation and answers to technical questions do not grant the person receiving them any rights to the Widget, other than the right to review it in order to decide whether to enter into a contract. The restrictions of clause 6.3 apply to a prospective customer from the moment any such materials are received, regardless of whether a contract is concluded.

6.5. You are responsible for compliance with these Terms by all persons who obtain access to the Widget, its settings, documentation or the dashboard through you or on your behalf — employees, contractors, freelancers, web studios, agencies, developers and integrators. Their actions are deemed to be your actions. You must inform them of the restrictions of clause 6.3 before granting access.

6.6. The Widget files contain copyright notices, a version number and a link to the terms; the Service verifies the origin of every configuration request. Removing or altering these notices and circumventing the checks constitute separate copyright infringements (items 5 and 6 of part two of Article 53 of the Law of Ukraine “On Copyright and Related Rights”).

6.7. In the event of a breach of clauses 6.3–6.6, we have the right to terminate access to the Service immediately (in that case, the amounts paid are refunded only in the cases provided for in the Refund Policy), to demand that the infringement cease and that copies be withdrawn (Article 432 of the Civil Code of Ukraine), to recover compensation under Article 55 of the Law of Ukraine “On Copyright and Related Rights”, and to use other remedies provided by law.

6.8. Clauses 6.1–6.7 survive termination of the subscription, deletion of the Account and removal of the Widget from your Websites.

6.9. Hosting the Widget on your own infrastructure, changing its interface, embedding it in your own product or offering it under your own brand is possible only under a separate written licence — write to [email protected].

More about the rights to the Widget and the consequences of copying — on the Accessibility Panel rights page.

7.2. The Accessibility Panel (Widget) runs in the browser and does not transmit visitor data to servers.

12.3. Disputes not settled under clause 12.2 are resolved by the courts of Ukraine in accordance with the jurisdiction rules established by the procedural legislation of Ukraine. For Users located outside Ukraine, the law of Ukraine remains applicable.

12.4. These Terms are drawn up in Ukrainian. In the event of translation into another language, the Ukrainian text prevails.

12.5. The invalidity of any provision of these Terms does not render the other provisions invalid. Our failure to exercise any right under these Terms does not constitute a waiver of it.
